Terms of Service

Welcome to StrataDex. These Terms of Service ("Terms") govern your access to and use of stratadex.net and any related services (together, the "Service") operated by StrataDex ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility

You must be at least 13 years old to use StrataDex. If you are under 18, you may only use the Service with the involvement of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Accounts

You may browse most of the Service without an account, but creating teams, using Deep Dive+, and posting to the community require you to register. When you create an account you agree that:

• The information you provide is accurate and kept up to date.
• You are responsible for maintaining the security of your password and all activity under your account.
• You will notify us immediately at stratadex@gmail.com if you suspect unauthorised access.
• You will not create an account using another person's identity or a false name.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

• Use automated tools (bots, scrapers, crawlers) to access the Service except for public search engines respecting our robots.txt.
• Circumvent usage limits, paywalls, or access controls — including the Deep Dive+ free-tier limits.
• Attempt to access accounts, data, or systems you are not authorised to access.
• Reverse engineer, decompile, or otherwise attempt to derive the source code of the Service.
• Upload or share content that is illegal, harassing, hateful, obscene, defamatory, or infringes intellectual property.
• Interfere with the Service's normal operation (DDoS, injection attacks, malware, etc.).
• Use the Service to send unsolicited messages, spam, or commercial solicitations.
• Resell, sublicense, or redistribute Service data without written permission.

4. User Content

Community team posts, journal entries, comments, and similar content you submit ("User Content") remain your property. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and distribute that content on the Service.

You are solely responsible for your User Content. We do not pre-moderate posts but reserve the right to remove any User Content that violates these Terms or applicable law. Repeat offenders may be banned.

5. Subscriptions & Billing

StrataDex offers paid subscription plans ("Pro" and "Champion") billed via Stripe. By subscribing you agree that:

• Subscriptions automatically renew at the end of each billing period (monthly or annual, as selected at checkout) unless cancelled before renewal.
• You can cancel anytime from the Pro page or by emailing stratadex@gmail.com. Cancellation takes effect at the end of the current billing period.
• Paid features remain available through the end of the period you have already paid for. After that your account reverts to the free Trainer tier.
• We may change subscription pricing with at least 14 days' notice; changes affect future billing periods only. Existing annual subscribers are honoured at their current price through the end of their annual term.
• All payment data is collected and stored by Stripe. We never see your card details.

6. Refund Policy

All subscription sales are final. StrataDex does not issue refunds — including pro-rated refunds — for cancelled subscriptions, unused portions of a billing period, missed features, planned downtime, or any other reason, except as required by applicable law or as stated below.

What this means in practice

• If you cancel mid-month, you will keep full access until the end of your current billing period and then be moved to the free tier — you are not billed again, but also not refunded for unused days.
• Annual subscribers who cancel keep access until the end of their paid year and are not refunded for remaining months.
• We do not offer refunds based on feature changes, service changes, or personal preference changes after purchase. Please try the free Trainer tier first to evaluate the product.

Exceptions

The above policy does not limit your rights under consumer-protection laws that cannot be waived by contract. Specifically, StrataDex will investigate and, where appropriate, reverse or refund:

• Billing errors — duplicate charges, incorrect amounts, or charges made after a confirmed cancellation.
• Unauthorized charges — charges made on your card without your consent.
• Payments mandated by law in your jurisdiction (for example, statutory cooling-off periods where applicable).

To report any of the above, email stratadex@gmail.com within 30 days of the charge and include your account email and the relevant transaction date. You also retain all chargeback and dispute rights provided by your card issuer under the US Fair Credit Billing Act and equivalent consumer-protection laws.

No refunds for Deep Dive+ usage

Deep Dive+ analyses, once generated, cannot be refunded or recredited. This includes analyses you are dissatisfied with, analyses produced while service was degraded, and analyses consumed against a cap on a plan you subsequently cancel.

7. Advertising

Free users see ads served by Google AdSense. By using the free tier you consent to Google's advertising cookies and terms. Pro and Champion subscribers are excluded from all ad serving. You can opt out of personalised ads via g.co/adsettings. See our Privacy Policy for details.

8. Intellectual Property & Pokémon Content

StrataDex is a fan-made resource and is not affiliated with, endorsed, or sponsored by Nintendo, Game Freak, Creatures Inc., or The Pokémon Company.

Pokémon and all related names, characters, sprites, and imagery are trademarks and copyrights of their respective owners. We display this content under fair-use principles for commentary, analysis, and competitive discussion. If you are a rights holder and believe content should be removed, please contact us at stratadex@gmail.com.

All original StrataDex content — our design, code, written guides, tier ratings, usage analysis, and branding — is owned by StrataDex and protected by copyright. You may link to the Service but may not reproduce our original content without permission.

9. Third-Party Services

The Service relies on third-party infrastructure providers for hosting, payments, email, and other backend functions. Their availability and terms are outside our control. We are not responsible for any failures, outages, or changes caused by third-party services.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or accurate. Tier ratings, usage statistics, team analysis, and all other data are provided for informational purposes only and should not be treated as professional advice. Your competitive results may vary — use StrataDex at your own discretion.

11. Limitation of Liability

To the maximum extent permitted by law, StrataDex and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, data loss, or loss of competitive standing — arising from your use of or inability to use the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or USD $50, whichever is greater.

12. Indemnification

You agree to indemnify and hold StrataDex harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, without notice, if you violate these Terms or engage in conduct that we believe is harmful to other users, third parties, or the Service itself. You may terminate your account at any time by emailing stratadex@gmail.com. Sections 7–11 survive termination.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where reasonable, notify registered users by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts located in the state where StrataDex is operated, unless otherwise required by applicable consumer protection law.
